1. Introduction

Welcome to Blue Collar Website Services ("we," "us," or "our"). By signing up for our services, you agree to the following terms. We believe in doing business simply and honestly, so we have written these terms in plain English to avoid confusion.

2. The Service

We provide website design, development, hosting, and maintenance services for trade businesses.

Subscription Plan: Includes a custom website, hosting, SSL certificate, and ongoing content updates for a flat monthly fee.

Lump Sum Plan: Includes a custom website build for a one-time fee, with a separate lower monthly fee for hosting. Content updates are billed hourly.

3. Payment & Contracts

The Subscription Model ($89/mo)

Commitment: This plan requires a 12-month minimum commitment. By signing up, you agree to make 12 consecutive monthly payments.

Early Cancellation: If you wish to cancel before the 12 months are up, the remaining balance of the 12-month contract is due immediately.

After 12 Months: After the initial term, your service converts to a month-to-month agreement. You may cancel at any time with 30 days' notice.

The Lump Sum Model ($2,500)

Payment: 50% is due upfront to begin work, and the remaining 50% is due upon website launch.

Hosting: A separate monthly hosting fee (currently $30/mo) applies to keep the site live.

4. Ownership of Content

Who Owns What?

You Own: All text, images, and branding assets (logos) you provide to us. You retain full copyright of your business data.

We Own: The website design, code structure, and CMS configuration.

Rights Upon Cancellation:

Subscription Plan: If you cancel your service, your website will be taken offline. You do not own the website design or code. If you wish to take the website with you to another host, a buyout fee of $1,500 applies.

Lump Sum Plan: You own the website design and code upon full payment of the $2,500 fee. You are free to move the site to another host at any time (webflow export fees may apply).

5. "Lifetime Updates" Policy

For Subscription clients, "Lifetime Updates" includes:

Changing text, swapping images, updating contact info, and adding projects to your gallery.

What is NOT included: Complete redesigns of the website, adding new functionality (like e-commerce stores), or massive structural changes. These are billed at our standard hourly rate ($125/hr).

6. Client Responsibilities

You agree to:

Provide necessary content (logos, images, text) in a timely manner.

Ensure you have the legal right to use any images or text you provide to us.

Pay your invoices on time. We reserve the right to suspend your website if payment is more than 15 days late.

7. Limitation of Liability

We strive for 99.9% uptime, but the internet is unpredictable. Blue Collar Website Services is not liable for any lost revenue, lost leads, or damages resulting from:

Server downtime or technical failures (via Webflow).

Search engine ranking fluctuations (SEO is never guaranteed).

Third-party service interruptions.

8. Governing Law

These terms shall be governed by the laws of the State of North Carolina.
